Terms of Service

These are the working Terms of Service for the Kinoku Android app. Formal legal review is still pending.

Who we are

Kinoku is operated by DREAM SOFT DISTRIBUTED EOOD in Plovdiv, Bulgaria. "Kinoku" is the product and trading name. Contact: hello@kinoku.app.

Acceptance

By installing, accessing, or using the Kinoku Android app, the Wear OS companion, or the marketing website, you agree to these Terms and the Privacy Policy. If you do not agree, do not install or use the Service.

Eligibility

You must be at least 16 years old to use Kinoku. Users under 18 should use the app under parental supervision.

Subscriptions

Google Play bills PRO and ELITE subscriptions. Auto-renewal, billing settings, and standard refund controls are handled through Google Play. Where available, Kinoku may also offer lifetime purchase options through Google Play. "Earned tier time" is an in-app reward and not a refundable credit.

Acceptable use

You agree not to:

• Use the app for unlawful purposes
• Abuse Social Bets through impersonation, harassment, spam, or fraud
• Attempt to circumvent the subscription system
• Use automated means to fabricate fitness data for unfair advantage in rewards or bets
• Reverse engineer, decompile, or redistribute the app except where the law requires us to permit it

Health disclaimer

Kinoku is not a medical device and does not provide medical advice. Training insights, cycle-aware context, readiness signals, AI Coach, and other guidance are educational and informational only. Talk to a qualified physician before you start any exercise programme. Talk to a qualified trainer for exercise technique. You take full personal responsibility for your training decisions.

Assumption of risk

Exercise carries inherent risks. By using Kinoku you take on those risks of your own free will. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable consumer-protection law.

Social Bets

Social Bets target values are in-app numbers (workout counts, streaks, kg of volume). They are not money amounts, and Kinoku does not back them. Off-platform stakes, if any, are the participants' own arrangement. You can leave any bet from Settings → Import & Export → Your Data Rights → Leave all Social Bets.

Your data

Your training data is yours. The code, design, branding, and product assets stay the property of DREAM SOFT DISTRIBUTED EOOD. Cycle, period, fertility, and pregnancy data get the enhanced protections described in the Privacy Policy's reproductive-health section.

AI features

Training Insights, Smart Suggestions, Weight Progression, AI Coach, and related AI features find patterns in your local workout data. They are not medical advice and may not account for your individual circumstances.

Availability and changes

Kinoku may change over time. Features may be added, improved, or retired as the product changes. But the core privacy and ownership model described publicly is meant to stay central to the app.

Limitation of liability

To the maximum extent permitted by law, DREAM SOFT DISTRIBUTED EOOD is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the app. Where the law allows a total-liability cap, it is limited to the amount you paid for the service in the 12 months before a claim. EU consumer-protection law applies where required.

Termination

You may end your use by uninstalling the app. We may suspend or end access to optional networked features for abuse or material breach. Your local data stays on your device until you delete it. Your Firestore presence, if any, can be removed before you uninstall.

Governing law

These Terms are governed by the laws of Bulgaria, subject to any mandatory consumer protection rights that apply in your jurisdiction. Nothing in this clause limits mandatory dispute-resolution or consumer-protection rights available where you live.

Changes to these Terms

Material changes raise the version and "Last updated" date. Continued use after re-acceptance counts as agreement.
